1. General Provisions

1.1. Scope

These Terms and Conditions for the use of radicant Debit Cards (“Debit Cards T&Cs”) govern the issuance and use of Debit Cards offered by radicant bank ag, Mühlebachstrasse 162-164, 8008 Zurich, Switzerland (“radicant”) to the client (“You”).

The provisions of these Debit Cards T&Cs shall apply to both virtual and physical Debit Cards provided by radicant.
In addition to these Debit Cards T&Cs, Banking Services T&Cs, radicant Basic Agreement, and other provisions governing the banking relationship between You and radicant shall apply.

2. Your Debit Card

2.1. Account relationship and Debit Card

If You are a radicant bank account holder You are entitled to receive the associated Debit Card (“Your Debit Card”)
The Debit Card is linked to the account for which it was issued and is always issued in the name of the person entitled to the bank account.

In principle, the Debit Card is issued as a virtual card, displayed within the radicant app. You can add Your Debit Card to other Digital Wallets supported by radicant according to the Mobile payments by wallet T&Cs. radicant shall provide You with a physical Debit Card upon Your explicit request. radicant may charge a fee for issuing a physical debit card.

2.2. Debit Card use, limits, and functionality

radicant determines which uses of the Debit Card are allowed. Your Debit Card can be used:

  • to pay for goods and services from merchants in Switzerland and abroad;
  • to pay for goods and services online, over the phone or by post, or using other means of correspondence;
  • to withdraw cash at ATMs, counters, and designated merchants in Switzerland and abroad; and
  • to make mobile payments by saving a token instead of the card details in a Digital Wallet provided by radicant or a third party.

Using the Debit Card for unethical or illegal purposes is prohibited.

radicant sets limits for each Debit Card issued and discloses them in a proper manner. Limits can be changed by radicant at any time. You are entitled to set personal limits within the framework authorised by radicant.

Your Debit Card may only be used if sufficient balance is available on the associated radicant bank account. radicant reserves the right to reject a transaction without giving any reasons if Your radicant bank account balance is insufficient (e.g., booking the transaction would result in a negative balance) or if the withdrawal, or payment limits are exceeded. If a transaction is rejected, radicant shall not be liable for any consequential or associated losses or expenses, such as default interest or reminder fees.

When Your Debit Card is used to carry out a transaction in a currency other than the radicant bank account currency, radicant will convert the amount of the transaction into the radicant bank account currency at the applicable exchange rate on the day when it receives the notification of the transaction.

You can submit instructions, activate, or deactivate Your Debit Card functionalities (e.g., contactless payments, online purchases) via the radicant app.

2.3. Identification and risk transfer

radicant is entitled to debit the transacted amounts and to book them to the associated radicant bank account.

Any person, who inserts Your physical Debit Card and enters the correct PIN code into a device equipped for this purpose, uses Your virtual or physical Debit Card (e.g. to make a contactless payment), signs the transaction slip, provides the name indicated on Your Debit Card, Debit Card number, the expiry date and the three-digit security code (CVV, CVC), or identifies himself or herself in another manner specified by radicant, is considered to be authorized to use Your Debit Card. This applies even if the authorized person is not You as the cardholder within the meaning of these Debit Card T&Cs.

You acknowledge and agree to bear potential risks arising from any misuse of Your Debit Card by third persons. You acknowledge and accept that radicant assumes no liability for transactions concluded using Your Debit Card, nor does radicant assume any liability if a payment or withdrawal cannot be executed. This also applies if Your Debit Card is damaged or rendered unusable (e.g., by an ATM).

2.4. Debit Card validity and replacement

You are required to set up a personal identification number (PIN) for Your virtual Debit Card in Your radicant app according to the instructions provided by radicant. If you want to change your PIN, you can do so in the settings related to Your Debit Card within the radicant app in the section “New PIN”.
In case You request a physical Debit Card, radicant will provide You with a personal identification number (PIN) for the physical Debit Card. After receiving the initial PIN code provided by radicant, You must replace it with a new combination of numbers that are not easily identifiable or deductible (e.g., not a birthday date). If You want to change the PIN code of Your physical Debit Card, you can do so in the settings related to Your Debit Card within the radicant app in the section “New PIN”. To activate Your new PIN code, You will be required to validate it at an ATM by inserting Your physical Debit Card and typing the new PIN code You set in the radicant app.

Your Debit Card shall remain valid up to and including the expiration date displayed on it. radicant will automatically replace Your Debit Card with a new one before the indicated expiration date, unless the services are used improperly, or termination has occurred.

If You need to replace Your Debit Card, You should request a new Debit Card via the radicant app or via other appropriate means provided by radicant. Fees might be charged for the replacement. After receiving Your new physical Debit Card, You are required to immediately render Your old Debit Card unusable.

2.5. Your duty of care

You must always comply with the duties of care outlined below:

  • If Your Debit Card has a signature field, You must sign it immediately upon receipt;
  • You must keep Your physical Debit Card and its PIN code in a safe place and store them with care to make sure that both are not accessible to unauthorised third parties. The PIN code should not be stored together with Your Debit Card and should not be sent, forwarded, or made accessible to third parties in any other way. If You suspect that a third party has become aware of the PIN code, You must change it without delay;
  • You must not disclose the PIN code of your virtual Debit Card nor provide access to Your device, where the Your virtual card is stored, to unauthorized third parties. If you suspect that an unauthorized third party has become aware of Your PIN code or gained access to Your device, You must change the respective PIN code(s) without delay;
  • You are prohibited from transferring Your Debit Card, particularly by lending or making it available to unauthorized third parties;
  • Credit and debit notifications are available at any time within the radicant app. You must inform radicant without delay, but not later than 30 days from the date when You become aware that one of Your accounts has been erroneously credited/debited or has been credited/debited with an incorrect amount;
  • You must immediately report to the police any instance of loss, theft, or potential criminal act involving Your Debit Card. You are further required to cooperate in any investigation and make every effort to minimize the loss;
  • If Your Debit Card or related PIN is lost, or if Your physical Debit Card remains stuck in a device, You must inform radicant immediately;
  • You are required to immediately render Your blocked or terminated Debit Card unusable. You must further inform all suppliers and merchants being paid with Your Debit Card or where Your Debit Card credentials are stored for recurring services, pre-authorised payments, booking or reservation.

radicant shall inform You in an appropriate manner if additional duties of care are required.

2.6. radicant’s right to debit

radicant is authorized to debit all amounts incurred when using Your Debit Card, all applicable costs, and fees, including amounts reserved or provisionally booked from Your radicant bank account. Such amounts will be debited to Your radicant bank account and result in a reduction of available liquidity. An overdraft is not possible for payments and cash withdrawals.

radicant’s right to debit remains in full force in case of disputes between You and third parties.
Disputes about goods or services and any potential claims must be settled between You and the third party. When returning goods, a credit confirmation must be requested from the third party. In case of a transaction cancellation, a confirmation of cancellation must be requested from the third party.

Despite the blocking or cancellation of the card, radicant shall debit Your radicant bank account for all amounts due for recurring services.

2.7. Disclosure of data and data processing by third-party

radicant may obtain, process, and disclose data concerning Your Debit Card and related transactions to third parties in Switzerland or abroad:

  • where it is necessary for completing transactions, information will be provided to the banks involved, the operators of payment systems and the recipient;
  • insofar as required to provide services according to these Debit Cards T&Cs, to comply with disclosure obligations under the law, and to safeguard radicant’s legitimate interests (e.g., in the context of recovery proceedings);
  • to the extent necessary for compliance purposes such as AML checks, reciprocal exchange and retrieval of data may include all details relating to You, the relationship between You and radicant, and any beneficiaries and other parties involved in the banking relationship;
  • as part of the provision and use of Your Debit Card, third parties may be involved to produce means of identification, for the regulation and processing of information and transactions, and for the prevention and detection of fraud.

Such third parties and their subcontractors, if appointed, may receive Your Debit Card information and transaction details. All data transmitted abroad are not protected by Swiss law. To this extent, You expressly release radicant from its obligation to maintain banking secrecy and, as far as permitted by law, from applicable data protection legislation.

2.8. Blocking and termination

These Debit Cards T&Cs shall be applicable for the duration of Your contractual relationship with radicant. Either party may, terminate the contractual relationship at any time, taking in account the timeframe required for settling all accounts and assets. You acknowledge that the termination of Your radicant bank account will result in termination of Your Debit Card.

radicant is entitled to block Your Debit Card at any time without prior notification and without providing reasons.
radicant will block Your Debit Card upon Your explicit request within the radicant app or if You report the loss or misuse of Your Debit Card or the related PIN code. radicant may also terminate Your Debit Card if it has not been used for a period exceeding 2 years. Should any of the mentioned events occur, You must render the affected Debit Card unusable immediately by destroying it.

radicant remains entitled to debit all transacted amounts to Your radicant bank account before blocking or termination becomes effective.

Early termination or blocking of Your Debit Card does not entitle You to a refund of the fees related to the Debit Card, where applicable.

3. Liability

radicant is not liable for any losses due to the use, including fraudulent and improper use, of Your Debit Card by third parties.

Losses covered by the indemnity liability of an insurance company and all consequential losses shall not be borne by radicant.

You are not entitled to claim compensation for technical failures and faults that result in Your Debit Card being unusable or if a merchant refuses to accept Your Debit Card as a means of payment. radicant assumes no liability for the accuracy or completeness of information and reports provided by machines, terminals, screens, or other IT systems. Account entries (e.g., balance) are preliminary and non-binding unless expressly identified by radicant as binding.
