1. General Provisions

1.1. Scope

These Terms and Conditions for Mobile Payments by Wallet (“Mobile Payments T&Cs”) apply when an radicant Debit Card is stored and used electronically in a mobile payment solution (“Digital Wallet”) offered through one or more software application(s) provided by a third party (“Wallet Provider”) usable on mobile phones, tablets, watches or other devices (“Devices”) that support Digital Wallets.

These Mobile Payments T&Cs apply and are to be considered in conjunction with the Banking Services T&Cs, where the general provisions governing the entirety of Your contractual relationship with radicant can be found, as well as with the radicant Basic Agreement, and the Debit Cards T&Cs. Terms and Conditions as well as policies of each Wallet Provider equally apply to Your use of the Digital Wallet service.

1.2. Fees

All fees and expenses that Wallet Providers may charge in connection with the installation or use of the Digital Wallet shall be borne by You.

radicant is not charging any fees for using the Digital Wallet.

1.3. Amendments to these Mobile Payments T&Cs

radicant is entitled to amend and update the Mobile Payments T&Cs at any time. You will be duly notified of any changes implemented by radicant. If You continue to use the Digital Wallet service, the changes will be deemed accepted.

The Wallet Provider(s) may change their Terms and Conditions for the use of the Digital Wallet services at any time.

2. Activation, use and responsibility

By linking Your Debit Card to the respective Digital Wallet on Your Devices, You will be able to make contactless payments online or on-site at an acceptance point, in Switzerland and abroad and in apps offered by merchants and providers who accept Digital Wallets as a payment method.

You may set up one or more Digital Wallets within Your Devices. The Wallet Provider determines the applicable method for the registration of Your Debit Card, as well as the manner and timeframe in which transactions are approved. The Wallet Provider is solely responsible for the services and functionality of the Digital Wallet. All related services are provided on the basis of the contract concluded between the Wallet Provider and You.

You are aware and acknowledge that any person who accesses Your Devices, authorizes a transaction via Your Devices, sets up a Digital Wallet as a payment method on Your devices, or uses the Digital Wallet in any other way is deemed to be authorized, even if that person is not You.

If You allow other persons to use Your Debit Card within a Digital Wallet, You are responsible for any transactions they authorize to the extent permitted by applicable law.

3. Data processing

To the extent Your Data constitutes personal data according to applicable data protection laws and regulations, radicant processes such data, as well as any other personal data that You have provided radicant with or that has been collected by radicant in the course of its business relationship with You, in accordance with the applicable laws and regulations. For the principles for the processing of personal data, and the purposes for which personal data is processed by radicant, please refer to the Data Protection Notice radicant apps.

When using Digital Wallets, information and data are exchanged between the parties involved, such as Wallet Providers, international debit/credit card networks as well as any third parties commissioned by them. Wallet Providers collect and process information related to transactions and data stored in Your Devices independently from radicant, for their own purposes, under their own contractual terms and conditions and privacy policy. For any questions or objections regarding the Wallet Provider’s data processing, You should contact the Wallet Provider.

Data can be processed in Switzerland or abroad. All data transferred abroad is not protected by Swiss law. To this extent, You expressly release radicant from its obligation to maintain banking secrecy and, as far as permitted by law.

4. Duty of care and other client obligations

When using Digital Wallets, You are obliged to observe additional duty of care to the one already stipulated in the Debit Cards T&Cs, as well as duties of care required by the Wallet Provider You are using. In particular:

  • You must keep Your personal identification (e.g., password, screen lock, biometry, numeric code) secret and not make it accessible to unauthorized third parties. You must keep said codes and screen locks separate from Your devices;
  • You are obliged to keep the operating systems and other applications on Your Devices up-to-date;
  • You must not carry out any manipulations or install any applications or operating systems that are not permitted by the Wallet Provider, or are otherwise unofficial;
  • You are obliged to inform radicant immediately in the event of suspected unauthorized access to or loss of Your Devices or means of identification.

You hereby accept the liability for all risks and consequences arising from the use, including fraudulent use, of Your Digital Wallet(s). radicant’s liability for damages is subject to the stipulations of the Debit Cards T&Cs.

5. Termination and blocking

Each party may, in accordance with the Wallet Provider's stipulations, terminate the use of the Digital Wallet service at any time without specifying a reason. Termination of the service will not affect the radicant Debit Card status which shall continue to be valid.

Any blocking, termination or replacement of Your Debit Card will have an impact on its use within Digital Wallets.
Should the Digital Wallet malfunction, You can continue to use the radicant Debit Card.

radicant reserves the right to terminate or restrict the use of specific Digital Wallets in full or in part at its sole discretion without stating reasons. If termination occurs, You shall immediately delete Your Debit Card details from the restricted Digital Wallet. radicant shall remain entitled to debit all amounts related to transactions made prior to the termination of the Digital Wallet Service from Your radicant bank account, even if the transactions are received after the termination of the Digital Wallet service.

6. Liability

radicant is not the provider of the Digital Wallet payment solution, it merely facilitates You storing Your Debit Card within a Digital Wallet. Therefore, use and installation of the Digital Wallet remains outside radicant's control.

radicant is not liable for the Wallet Provider’s performance, or any damages resulting from the use of a Digital Wallet. radicant cannot guarantee trouble-free and uninterrupted access to the Digital Wallet services, particularly in cases of technical malfunctions or defects and maintenance works on the service provider’s side.

If You allow other persons to use Your Debit Card within Digital Wallets on Your Devices or allow Your Debit Card to be linked to Devices different from Your own, You are responsible for all transactions that are authorized in that context insofar as permitted by applicable law.

You are solely responsible for the availability of compatible Devices supporting the use of Digital Wallets.
